1. WHO WE ARE

Medicare Experts is a licensed health insurance agency. "Medicare Experts" is a trade name (DBA) of Optimum Financial Brokerage, Inc. Our licensed agents help eligible consumers compare and enroll in Medicare-related insurance products offered by the carriers with whom we have a current appointment. Any application or enrollment takes place separately, off this Site, with a licensed agent.

2. NOT AFFILIATED WITH THE U.S. GOVERNMENT

Medicare Experts is not connected with or endorsed by the U.S. government, the federal Medicare program, the Centers for Medicare & Medicaid Services (CMS), or any state agency. Medicare has neither reviewed nor endorsed the information on this Site.

3. MEDICARE DISCLAIMER

We do not offer every plan available in your area. Any information we provide is limited to those plans we do offer in your area. Please contact Medicare.gov or 1-800-MEDICARE (TTY 1-877-486-2048), 24 hours a day, 7 days a week, or your local State Health Insurance Assistance Program (SHIP) to get information on all of your options.

4. NO INSURANCE CONTRACT THROUGH THE SITE

Nothing on the Site constitutes an offer to sell or a solicitation to purchase insurance where such offer or solicitation would be unlawful. Submitting a form, requesting a quote, or speaking with one of our agents does not create an insurance policy, bind coverage, or guarantee enrollment. A policy is only issued by the insurance carrier after a completed application is approved by that carrier.

5. ELIGIBILITY

The Site is intended for U.S. residents who are at least 18 years of age. You represent that you are at least 18 and have authority to provide any information you submit, including information about anyone other than yourself.

6. CONSENT TO BE CONTACTED

By submitting your phone number or email through the Site, you consent to be contacted by Medicare Experts and our licensed agents — including by telephone (which may include autodialed or prerecorded calls), email, and, if you separately opt in, by text message — for the purpose of discussing Medicare and other insurance products. Your consent is not a condition of any purchase. Standard message and data rates may apply. You may revoke consent at any time as described in our Privacy Policy or SMS Terms.

7. INTELLECTUAL PROPERTY

The Site and all content on it — including text, graphics, logos, images, and the "Medicare Experts" name and logo — are owned by Optimum Financial Brokerage, Inc. or its licensors and are protected by U.S. and international intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to view and use the Site for personal, non-commercial purposes. You may not copy, modify, distribute, sell, frame, scrape, or create derivative works of any portion of the Site without our prior written consent.

8. THIRD-PARTY LINKS

The Site may contain links to third-party websites, including carrier sites and Medicare.gov. We do not control and are not responsible for the content, accuracy, or privacy practices of third-party sites. Links do not imply endorsement.

9. NO PROFESSIONAL ADVICE

The Site provides general information about Medicare and related insurance products and is not medical, legal, tax, or financial advice. For advice specific to your situation, consult a qualified professional. Coverage decisions should be based on the official plan documents issued by the insurance carrier.

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. PLAN BENEFITS AND PRICING ARE SET BY THE CARRIER, NOT BY MEDICARE EXPERTS, AND ARE SUBJECT TO CHANGE.

11. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER MEDICARE EXPERTS NOR OPTIMUM FINANCIAL BROKERAGE, INC., NOR OUR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES, WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

12. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Medicare Experts and Optimum Financial Brokerage, Inc., and our officers, directors, employees, agents, and affiliates, from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) your violation of these Terms, (b) your misuse of the Site, or (c) your violation of any law or the rights of any third party.

13. PROHIBITED USES

You agree not to use the Site to (a) submit false or fraudulent information, (b) impersonate any person or entity, (c) transmit viruses or malicious code, (d) attempt to gain unauthorized access to any part of the Site or our systems, (e) scrape or harvest information, or (f) use the Site in violation of any applicable law, including the Telephone Consumer Protection Act.

14. CHANGES TO THE SITE OR THESE TERMS

We may modify, suspend, or discontinue the Site at any time without notice. We may also update these Terms from time to time. If a revision is material, we will provide at least thirty (30) days' notice on the Site before the new Terms take effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the Site after changes take effect constitutes acceptance.

15. TERMINATION

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including violation of these Terms. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution — will survive.

16. GOVERNING LAW; VENUE

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. Except as provided in Section 17, any action arising out of or relating to these Terms will be brought exclusively in the state or federal courts located in Wake County, North Carolina, and you consent to the personal jurisdiction of those courts.

17. DISPUTE RESOLUTION; ARBITRATION; CLASS WAIVER

Please read this section carefully. It affects your legal rights.

18. MISCELLANEOUS

These Terms, together with the Privacy Policy and SMS Terms, are the entire agreement between you and Medicare Experts regarding the Site. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any right is not a waiver. You may not assign these Terms; we may assign them.
