    This Privacy Policy explains how Optimum Financial Brokerage, Inc., a North Carolina corporation, doing business as "Medicare Experts" ("Medicare Experts," "we," "us," or "our"), collects, uses, shares, and protects information about you when you visit our website at https://www.yourmedicareexperts.com (the "Site"), call us, text us, attend an appointment with one of our licensed agents, or otherwise interact with us.

    By using the Site or our services, you consent to the practices described in this Policy. If you do not agree, please do not use the Site or submit information to us.

    1. WHO WE ARE

    Medicare Experts is a licensed insurance agency. "Medicare Experts" is a trade name (DBA) of Optimum Financial Brokerage, Inc. We help eligible consumers compare and enroll in Medicare-related and other insurance products offered by the carriers with whom we have a current appointment.

    2. INFORMATION WE COLLECT

    We collect information in three general ways: (a) information you give us, (b) information we receive from third parties, and (c) information collected automatically when you interact with the Site.

    (a) Information you give us. This may include:

    • Identifiers and contact information: name, mailing address, email address, telephone number, ZIP code, date of birth.
    • Eligibility information: Medicare ID/MBI (when you provide it during an enrollment), Medicaid status, Social Security disability status, Veterans Administration coverage status, current insurance carrier and plan.
    • Health-related information you choose to share: prescriptions you take, preferred doctors and pharmacies, general health conditions you mention while comparing plans. We collect only what is necessary to help you choose a plan.
    • Financial information: limited information such as your bank or card details only if you elect to set up premium payment directly with a carrier during an enrollment (we do not retain bank or card numbers on the Site).
    • Communications: the content of forms you submit, emails you send us, voicemails, and notes from conversations with our agents.

    (b) Information from third parties. We may receive information about you from:

    • Lead generation partners and referral sources who have obtained your permission to share your contact information with licensed insurance agents.
    • Insurance carriers, Medicare's Medicare Plan Finder, and pharmacy/drug pricing databases used to generate quotes.
    • Service providers (for example, our CRM, scheduling, e-signature, telephony, and SMS providers).

    (c) Information collected automatically. When you visit the Site we and our analytics/advertising providers may automatically collect:

    • Device and connection information: IP address, browser type and version, operating system, referring/exit pages, date/time stamps.
    • Usage information: pages viewed, links clicked, time spent on pages, and similar interaction data.
    • Cookies, pixels, and similar technologies, including the Meta (Facebook) pixel and other analytics or advertising tags. See Section 7 (Cookies and Tracking) below.

    3. HOW WE USE INFORMATION

    We use the information we collect to:

    • Respond to your requests, including providing quotes, scheduling appointments, and answering questions.
    • Compare available plans and assist you with enrollment with an insurance carrier.
    • Submit applications to carriers on your behalf when you authorize us to do so.
    • Provide ongoing service, including policy reviews, Annual Election Period check-ins, and assistance with claims or carrier issues.
    • Operate, maintain, secure, and improve the Site and our services.
    • Communicate with you by phone, email, mail, or โ€” if you separately opt in โ€” text message.
    • Comply with our legal, regulatory, and contractual obligations, including CMS Medicare marketing rules, state insurance department requirements, the Gramm-Leach-Bliley Act (GLBA), and HIPAA where applicable.
    • Detect and prevent fraud, security incidents, and abuse of the Site.
    • Send you information about other insurance products that may interest you (you can opt out at any time โ€” see Section 9).

    4. HOW WE SHARE INFORMATION

    We share information only as described below:

    (a) With insurance carriers and their affiliates, when you authorize us to submit an application or request a quote, in order to underwrite, issue, and service your policy.

    (b) With CMS and government agencies, where required for Medicare enrollment, Scope of Appointment recordkeeping, audits, or other regulatory purposes.

    (c) With service providers acting on our behalf, including:

    • CRM and marketing automation.
    • Telephony and call-recording providers used by our agents.
    • SMS / texting providers (subject to carrier 10DLC rules โ€” see SMS / Messaging Terms).
    • E-signature, scheduling, document storage, and email providers.
    • Hosting, analytics, and security providers.

    Service providers are permitted to use your information only to provide services to us and must protect it consistent with this Policy.

    (d) With our affiliates within the Optimum Financial Brokerage corporate family.

    (e) For legal reasons. We may disclose information to comply with a subpoena, court order, regulatory request, or other legal process; to enforce our Terms of Service; to protect the rights, property, or safety of Medicare Experts, our agents, or others; and to respond to claims of fraud or other wrongdoing.

    (f) In a business transaction. If we are involved in a merger, acquisition, financing, reorganization, or sale of assets, your information may be transferred as part of that transaction. We will require the receiving party to honor this Policy or notify you of any material change.

    WHAT WE DO NOT DO: We do not sell your personal information. Information you submit to us via the Site (including any information collected through SMS/text-message opt-in) is not shared with third parties for their own independent marketing purposes. Phone numbers and mobile opt-in data are not shared with third parties or affiliates for marketing purposes, in compliance with mobile carrier (10DLC) requirements.

    5. PROTECTED HEALTH INFORMATION (PHI) AND HIPAA

    Some information you share with us โ€” such as your prescriptions, medical conditions, or Medicare ID โ€” may be considered Protected Health Information (PHI) under the Health Insurance Portability and Accountability Act (HIPAA). When we handle PHI in connection with placing or servicing your insurance coverage, we treat it consistent with applicable HIPAA, GLBA, and state requirements. We use administrative, technical, and physical safeguards designed to protect PHI and limit access to personnel with a need to know.

    6. GRAMM-LEACH-BLILEY ACT (GLBA) PRIVACY NOTICE

    As a licensed insurance agency, we are a "financial institution" under the federal Gramm-Leach-Bliley Act. We collect nonpublic personal information about you from the sources described in Section 2 and share it as described in Section 4. We do not disclose any nonpublic personal information about our customers or former customers to nonaffiliated third parties, except as permitted by law (for example, to insurance carriers to service your policy, or to comply with legal process). We restrict access to your nonpublic personal information to employees, agents, and service providers who need to know that information to provide products and services to you.

    7. COOKIES AND TRACKING TECHNOLOGIES

    The Site uses cookies and similar technologies (including pixels, web beacons, and tags) to:

    • Remember your preferences and improve Site functionality.
    • Measure and analyze Site traffic and performance.
    • Deliver advertising on and off the Site, including through Meta (Facebook) advertising tools.

    You can control cookies through your browser settings. Most browsers let you block or delete cookies. You can also opt out of certain advertising cookies through industry tools such as the Digital Advertising Alliance (https://optout.aboutads.info) and the Network Advertising Initiative (https://optout.networkadvertising.org). Disabling cookies may limit some Site features.

    We do not currently respond to "Do Not Track" browser signals because there is no industry-standard interpretation. We do honor authorized opt-out preference signals where required by state law.

    8. THIRD-PARTY ANALYTICS AND ADVERTISING

    The Site may use third-party services such as Google Analytics, Meta (Facebook) pixel, and similar tools. These providers may use cookies and similar technology to collect information about your visits to the Site and other sites in order to provide analytics and targeted advertising. Their use of information is governed by their own privacy policies.

    9. YOUR CHOICES

    (a) Marketing communications. You may opt out of marketing emails by clicking the "unsubscribe" link at the bottom of any marketing email. You may opt out of marketing calls by asking us to add you to our internal Do-Not-Call list. You may opt out of marketing text messages at any time by replying STOP. Even if you opt out of marketing, we may still contact you about your existing policy, applications in progress, or service matters.

    (b) Updating your information. You may ask us to correct or update information you have provided by contacting us at the address or email in Section 1.

    (c) Closing your file. You may ask us to close your file, subject to our obligation to retain records as required by insurance, tax, and regulatory laws.

    10. STATE PRIVACY RIGHTS

    Depending on where you live, you may have additional rights with respect to your personal information.

    California residents (CCPA / CPRA). You have the right to:

    • Know what personal information we collect, use, disclose, and "share" (for cross-context behavioral advertising).
    • Request a copy of your personal information.
    • Request deletion of your personal information.
    • Request correction of inaccurate personal information.
    • Opt out of the "sale" or "sharing" of personal information. (We do not sell personal information in exchange for money. We may "share" limited information for cross-context behavioral advertising through tools like the Meta pixel; you may opt out by emailing us at the address in Section 1 or by using available browser controls and the "Limit the Use of My Sensitive Personal Information" tools described above.)
    • Limit the use and disclosure of sensitive personal information.
    • Be free from retaliation for exercising these rights.

    To exercise these rights, contact us at the email or address in Section 1. We will verify your request using the information you have on file with us. You may also authorize an agent to make a request on your behalf with appropriate written authorization.

    "Shine the Light" (California Civil Code ยง 1798.83). California residents may request information about disclosures of personal information to third parties for direct-marketing purposes. We do not disclose personal information to third parties for their direct-marketing purposes.

    Other states. Residents of Colorado, Connecticut, Virginia, Utah, Texas, Oregon, and other states with comprehensive consumer privacy laws may have similar rights, including the right to access, correct, delete, and opt out of targeted advertising or "sales." Contact us using the information in Section 1 to exercise these rights.

    11. DATA RETENTION

    We retain personal information for as long as needed to provide our services to you and to comply with applicable insurance, tax, anti-fraud, and other legal record-retention requirements. CMS rules generally require Medicare-related sales and enrollment records (including Scope of Appointment forms and call recordings) to be retained for at least ten (10) years. After retention obligations expire, we securely delete or de-identify the information.

    12. DATA SECURITY

    We use administrative, technical, and physical safeguards designed to protect personal information against accidental or unlawful destruction, loss, alteration, unauthorized disclosure, and access. No system, however, is completely secure. We cannot guarantee the security of information transmitted over the Internet or stored on our or our service providers' systems.

    13. CHILDREN'S PRIVACY

    The Site is intended for adults age 18 and older. We do not knowingly collect personal information from children under 13. If you believe we have collected such information, please contact us and we will delete it.

    14. INTERNATIONAL USERS

    The Site is intended for users located in the United States. We do not market our services outside the United States. If you access the Site from outside the United States, you do so at your own risk.

    15. THIRD-PARTY LINKS

    The Site may contain links to third-party websites, including carrier sites and Medicare.gov. This Privacy Policy does not apply to those sites. We encourage you to review the privacy policies of every website you visit.

    16. CHANGES TO THIS POLICY

    We may update this Privacy Policy from time to time. The "Last Updated" date at the top reflects the most recent version. Material changes will be highlighted on the Site and, where required by law, communicated to you directly. Your continued use of the Site after changes are posted constitutes acceptance of the updated Policy.
